Giveaway Terms & Conditions

1. Eligibility

1.1 This giveaway is open to residents of California, United States, aged 18 and over, excluding employees of Socal Family Festival, Moonlight Mocktails, Yallaaprl, and SSRperformance.

2. Agreement to Rules

2.1 By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements. In addition, you agree to accept the decisions of Socal Family Festival, Moonlight Mocktails, Yallaaprl, and SSRperformance as final and binding as it relates to the content of this giveaway.

3. Giveaway Period

3.1 Entries will be accepted online starting on June 10, 2024, and ending on June 21, 2024, at 11:59 PM Pacific Time. All online entries must be received by the specified end time.

4. How to Enter

4.1 To enter the giveaway, participants must complete the following steps:

• Like and share the Instagram post related to the giveaway.
• Tag three (3) different friends in a single comment on the Instagram post.
• Follow the Instagram accounts: @socalfamilyfestival, @moonlight_mocktails, @yallaaprl, and @ssrperformance.

4.2 Each comment with three tagged friends counts as an entry. There are no restrictions to the number of entries that a person can submit, however, each comment must have three friends (not previously tagged) tagged to qualify as an entry.

4.3 Entries that do not fulfill the above requirements or are incomplete may be disqualified at the sole discretion of Socal Family Festival, Moonlight Mocktails, Yallaaprl, and SSRperformance.

5. Prizes

5.1 The winners of the giveaway (the "Winners") will receive the following prizes:

• Three (3) day stay at a five-star hotel in Mecca (terms apply, see 5.2)
• Moonlight Mocktails Black Card (terms apply, see 5.3)
• Entry to Socal Family Fest
• Moonlight Mocktails hat
• Yallaaprl T-shirt

• One (1) day Lamborghini rental (terms apply, see 5.4)

5.2 Mecca Hotel Giveaway Terms and Conditions

1. Prize Details: The prize consists of three (3) nights of accommodation for two (2) adults in a double room at a five-star hotel in Mecca, including breakfast each morning.
2. Eligibility: This giveaway is open to participants who meet the entry requirements as specified by the giveaway promotion. Employees of Twin Island Travel and their immediate families are not eligible to participate.
3. Travel Dates: The prize must be redeemed and the stay must be completed within one (1) year from the date of notification to the winner, excluding blackout dates.
4. Blackout Dates: The prize is not valid during the period from November 15, 2024, to January 31, 2025. No exceptions will be made for stays during these dates.
5. Additional Offer: Winners who book the full travel package from Twin Island Travel will receive an additional one (1) night of accommodation in Medina. This additional night must be booked as part of the full package and is subject to availability and the terms and conditions of Twin Island Travel.
6. Non-Transferable: The prize is non-transferable, non-exchangeable, and cannot be redeemed for cash or any other form of compensation.
7. Reservation and Booking: The winner is responsible for contacting Twin Island Travel Customer Service directly to make the booking. Reservations are subject to availability at the time of booking.
8. Incidental Charges: All incidental charges, including but not limited to, additional meals, beverages, transportation, gratuities, and personal expenses, are the sole responsibility of the winner.
9. Identification and Verification: The winner must present valid identification and the original prize notification letter or email upon check-in at the hotel.
10. Modification and Cancellation: Twin Island Travel reserves the right to modify or cancel the giveaway at any time for any reason without prior notice. In the event of unforeseen circumstances, Twin Island Travel reserves the right to substitute the prize with an alternative of equal or greater value.
11. Liability: Twin Island Travel and the hotel shall not be held liable for any loss, damage, or injury sustained by the winner or any guest as a result of the prize acceptance or use.
12. Compliance with Hotel Policies: The winner and their guest must comply with all hotel policies and regulations during their stay. Failure to do so may result in the forfeiture of the prize.
13. Acceptance of Terms: By participating in the giveaway, the winner agrees to be bound by these terms and conditions.

5.3 Moonlight Mocktails Black Card Terms and Conditions

1. Validity Period: The Moonlight Mocktails Black Card is valid for a period of two (2) years from the date of issuance.
2. Event Exclusivity: This card is only valid for Moonlight Mocktails pop-up events. It is not valid for any in-store purchases or events not specified as pop-up events by Moonlight Mocktails.
3. Drink Entitlement: The cardholder is entitled to one (1) free drink per pop-up event. This offer cannot be combined with any other promotions, discounts, or offers.
4. Non-Transferable: The Black Card is strictly non-transferable and can only be used by the individual whose name appears on the card. Identification may be required to verify the cardholder's identity.
5. Name Specific: The Black Card is issued in the name of the original cardholder only and cannot be transferred, sold, or assigned to any other person.
6. Usage Limitations: The Black Card cannot be used for online purchases or any other Moonlight Mocktails services that are not pop-up events.
7. Lost or Stolen Cards: Moonlight Mocktails is not responsible for any lost, stolen, or damaged cards. Replacement cards will not be issued under any circumstances.
8. Misuse: Any misuse of the card, including but not limited to, attempts to transfer, sell, or fraudulently use the card, will result in the immediate cancellation of the card without any compensation or recourse.
9. Event Availability: The availability of pop-up events is subject to change at the discretion of Moonlight Mocktails. The cardholder is responsible for checking event schedules and availability.
10. Modification of Terms: Moonlight Mocktails reserves the right to modify these terms and conditions at any time without prior notice. Continued use of the Black Card constitutes acceptance of any revised terms.
11. Legal Compliance: The cardholder agrees to comply with all applicable laws and regulations in connection with the use of the Black Card.

5.4 Lamborghini Rental Terms and Conditions

1. Eligibility: Participants must have valid and active auto insurance with full coverage. Proof of insurance will be required before the rental period begins.
2. Driver's License: Participants must possess a valid driver’s license. The driver’s license must be valid and in good standing throughout the rental period.
3. Transferability: The prize is transferable to another individual, provided they meet all the eligibility criteria outlined in these terms and conditions. The transfer of the prize must be communicated to SSR Performance prior to the rental date and is subject to approval.
4. No Cash Value: The prize cannot be exchanged or redeemed for cash or any other form of compensation.
5. Entry Voidance: If you do not meet the eligibility criteria, your entry is void. SSR Performance reserves the right to disqualify any participant who does not meet the criteria or who provides false information.
6. Prize Details: The prize consists of a one-day rental of a Lamborghini vehicle provided by SSR Performance. The rental is subject to availability and must be scheduled in advance. The specific model of Lamborghini and rental date will be determined based on availability.
7. Rental Agreement: The winner (or the transferee) must sign a rental agreement with SSR Performance, which includes agreeing to all terms and conditions of the rental, including but not limited to, mileage limits, return times, and any additional fees for damages or late returns.
8. Liability and Responsibility: The winner (or the transferee) is responsible for any damage to the vehicle during the rental period, and any applicable fees or fines incurred during the rental. SSR Performance will not be liable for any accidents, injuries, or damages that occur during the use of the rental vehicle.

6. Odds of Winning

6.1 The odds of winning depend on the number of eligible entries received. There will be 3 winners randomly selected based on each qualified comment entry.

7. Donation to Palestine

7.1 For each Instagram story repost, $1 will be donated to Palestine.

8. Terms

8.1 Socal Family Festival, Moonlight Mocktails, Yallaaprl, and SSRperformance reserve the right, in their sole discretion, to cancel, terminate, modify or suspend the giveaway should virus, bug, non-authorized human intervention, fraud, or other cause beyond their control corrupt or affect the administration, security, fairness, or proper conduct of the giveaway. In such case, Socal Family Festival, Moonlight Mocktails, Yallaaprl, and SSRperformance may select the Winners from all eligible entries received prior to and/or after (if appropriate) the action taken by Socal Family Festival, Moonlight Mocktails, Yallaaprl, and SSRperformance. Socal Family Festival, Moonlight Mocktails, Yallaaprl, and SSRperformance reserve the right, in their sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the giveaway or website or violates these Terms & Conditions.

9. Winner Selection and Notification

9.1 The Winners will be selected through a random drawing from among all eligible entries received. The drawing will be conducted by Socal Family Festival, Moonlight Mocktails, Yallaaprl, and SSRperformance. The Winners will be notified via Instagram Direct Message within five (5) days following the winner selection. Socal Family Festival, Moonlight Mocktails, Yallaaprl, and SSRperformance shall have no liability for a winner's failure to receive notices due to spam, junk e-mail, or other security settings or for a winner's provision of incorrect or otherwise non-functioning contact information. If the Winners cannot be contacted, is ineligible, fails to claim the prize within seven (7) days from the time award notification was sent, the prize may be forfeited, and an alternate Winner selected. Receipt of the prize by the Winner is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT SOLE DISCRETION OF SOCAL FAMILY FESTIVAL, MOONLIGHT MOCKTAILS, YALLAAPRL, AND SSRPERFORMANCE) WILL RESULT IN WINNER'S DISQUALIFICATION AS WINNER OF THE GIVEAWAY, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

10. Publicity

10.1 Acceptance of the prize constitutes permission for Socal Family Festival, Moonlight Mocktails, Yallaaprl, and SSRperformance to use the Winner's name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

11. General Conditions

11.1 Socal Family Festival, Moonlight Mocktails, Yallaaprl, and SSRperformance reserve the right to cancel, suspend, and/or modify the giveaway, or any part of it, if any fraud, technical failures, or any other factor beyond their reasonable control impairs the integrity or proper functioning of the giveaway, as determined by Socal Family Festival, Moonlight Mocktails, Yallaaprl, and SSRperformance in their sole discretion. In such event, Socal Family Festival, Moonlight Mocktails, Yallaaprl, and SSRperformance reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment.

12. Limitation of Liability

12.1 By entering, You agree to release and hold harmless Socal Family Festival, Moonlight Mocktails, Yallaaprl, and SSRperformance and their subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant's participation in the giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the giveaway; (v) electronic or human error in the administration of the giveaway or the processing of entries.

13. Disputes

13.1 THIS GIVEAWAY IS GOVERNED BY THE LAWS OF THE UNITED STATES AND CALIFORNIA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this giveaway, participant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this giveaway shall be resolved individually, without resort to any form of class action, exclusively before a court located in California having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney's fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this giveaway). Participant further waives all rights to have damages multiplied or increased.
